This paper explores the role and resolution of disagreements between physicians and their diagnostic AI-based decision support systems. With an ever-growing number of applications for these independently operating diagnostic tools, it becomes less and less clear what a physician ought to do in case their diagnosis is in faultless conflict with the results of the DSS. The consequences of such uncertainty can ultimately lead to effects detrimental to the intended purpose of such machines, e.g. by shifting the burden of proof (...) towards a physician. Thus, we require normative clarity for integrating these machines without affecting established, trusted, and relied upon workflows. In reconstructing different causes of conflicts between physicians and their AI-based tools—inspired by the approach of “meaningful human control” over autonomous systems and the challenges to resolve them—we will delineate normative conditions for “meaningful disagreements”. These incorporate the potential of DSS to take on more tasks and outline how the moral responsibility of a physician can be preserved in an increasingly automated clinical work environment. (shrink)

About one third of patients with epilepsy have seizures refractory to the medical treatment. Electrical stimulation mapping is the gold standard for the identification of “eloquent” areas prior to resection of epileptogenic tissue. However, it is time-consuming and may cause undesired side effects. Broadband gamma activity recorded with extraoperative electrocorticography during cognitive tasks may be an alternative to ESM but until now has not proven of definitive clinical value. Considering their role in cognition, the alpha and beta bands could further (...) improve the identification of eloquent cortex. We compared gamma, alpha and beta activity, and their combinations for the identification of eloquent cortical areas defined by ESM. Ten patients with intractable focal epilepsy participated in a delayed-match-to-sample task, where syllable sounds were compared to visually presented letters. We used a generalized linear model approach to find the optimal weighting of each band for predicting ESM-defined categories and estimated the diagnostic ability by calculating the area under the receiver operating characteristic curve. Gamma activity increased more in eloquent than in non-eloquent areas, whereas alpha and beta power decreased more in eloquent areas. Diagnostic ability of each band was close to 0.7 for all bands but depended on multiple factors including the time period of the cognitive task, the location of the electrodes and the patient’s degree of attention to the stimulus. We show that diagnostic ability can be increased by 3–5% by combining gamma and alpha and by 7.5–11% when gamma and beta were combined. We then show how ECoG power modulation from cognitive testing can be used to map the probability of eloquence in individual patients and how this probability map can be used in clinical settings to optimize ESM planning. We conclude that the combination of gamma and beta power modulation during cognitive testing can contribute to the identification of eloquent areas prior to ESM in patients with refractory focal epilepsy. Since the late nineties there has been an increased interested in probabilistic logic learning, an area within AI that combines machine learning with logic-based knowledge representation and uncertainty reasoning. Several different formalisms for combining first-order logic with probability reasoning have been proposed, and it has been studied how models in these formalisms can be automatically learned from data. -/- This talk starts with a brief introduction to probabilistic logic learning, after which we will focus on a relatively new formalism known (...) as CP-logic. CP-logic stands for “causal probabilistic logic”. It is a knowledge representation formalism that allows us to write down rules that indicate that a certain combination of conditions may cause certain effects with a particular probability (e.g., tossing a coin may cause a result of heads or tails, each with 50% probability). Besides the fact that this formalism is interesting for knowledge representation in itself, it also offers interesting opportunities from the machine learning point of view. Indeed, given the semantics of these CP-logic programs, learning them from data amounts to extracting probabilistic causal influences from data. We will discuss recent research on learning CP-logic programs, including: algorithms for learning them; how they relate to graphical models; and applications of learning CP-logic programs. (shrink)

Utility functions often lack additive separability, presenting an obstacle for decision theoretic axiomatizations. We address this challenge by providing a representation theorem for utility functions of quasi-separable preferences of the form $$u(x,y,z)=f(x,z) + g(y,z)$$ on subsets of topological product spaces. These functions are additively separable only when holding z fixed but are cardinally comparable for different values of z. We then generalize the result to spaces with more than three dimensions and provide applications to belief elicitation, inequity aversion, intertemporal choice, (...) and rank-dependent utility. In order to refute the widely held belief that the game known as ‘Newcomb's paradox’ is physically nonsensical and impossible to imagine (e.g. because it involves backward causation), I tell a story in which the game is realized in a classical, deterministic universe in a physically plausible way. The predictor is a collection of beings which are by many orders of magnitude smaller than the player and which can, with their exquisite measurement techniques, observe the particles in the player's body (...) so accurately that they can predict his choice (in much the same way as we can predict the motion of celestial bodies). I argue that the player, by choosing whether to take only one box or both boxes, influences whether or not, in the past, the predictor put a million pounds into the second box. Yet, I establish that no causal paradox can arise in this set-up. (shrink)

Against the backdrop of recent scholarship related to Deuteronomy 26:5–11, the influential hypothesis formulated by Gerhard von Rad that this verse entails a ‘small historical creed’ will be re-evaluated. In addition to recent Old Testament scholarship, attention will be paid to migrant theory and a rereading of 26:5–11. It will be suggested that this ‘creed’ addressed the identity concerns of returning migrants or exiles from Babylon, as well as the peasant farmers who remained behind in Palestine. Thus, the creed is (...) not understood as an early cultic starting point of a theological tradition, but as a later synthesising framework that responded to theological challenges and tensions prevalent in Persian Yehud. What happens at the end of a clinical trial for an investigational neural implant? It may be surprising to learn how difficult it is to answer this question. While new trials are initiated with increasing regularity, relatively little consensus exists on how best to conduct them, and even less on how to ethically end them. The landscape of recent neural implant trials demonstrates wide variability of what happens to research participants after an neural implant trial ends. Some former research participants (...) continue to receive support for their devices (e.g., battery and component replacements, software updates, etc.). Others, when safe, have their neural implants removed through surgical explantation. Still others continue to live with a deactivated neural implant embedded in their body. In the United States, there are no uniform requirements to provide services, of any kind, after an neural implant study ends, and other nations are similarly facing this challenge. The existence of a post-trial gap in an expanding neural implant research ecosystem invites obvious questions: What is owed to neural implant research participants post-trial, and why has providing it been so difficult to accomplish in practice? To take a step forward on this difficult issue, we assembled one group of stakeholders – researchers funded for neuroethics grants by the National Institutes of Health – to explore possible starting points on one topic: ethical guidance for post-trial care of research participants in neural implant trials. Based on shared concerns discussed in the expert workshop the current paper is a call to action. It reports the key areas of convergence from the meeting and highlights important next steps towards developing much needed guidance. (shrink)

In the debate about actions in virtual environments two interdependent types of question have been pondered: What is a person doing who acts in a virtual environment? Second, can virtual actions be evaluated morally? These questions have been discussed using examples from morally dubious computer games, which seem to revel in atrocities. The examples were introduced using the terminology of “virtual murder” “virtual rape” and “virtual pedophilia”. The terminological choice had a lasting impact on the debate, on the way action (...) types are assigned and on how moral evaluation is supposed to be conducted. However, this terminology and its theoretical consequences, while sometimes resulting in correct results, lead to absurd results when applied across the board. It will be suggested that these absurd consequences can be avoided by a different answer to the question what people in virtual worlds are doing. Alleged virtual actions are first and foremost the creation and modification of data-structures and the resulting output in computer hardware. Such modifications of data structure and imagery can be performed with different intentions, purposes and styles, which will influence the type and moral evaluation of a user’s actions. This reinterpretation allows for a more complex analysis of the moral reasons for praiseworthiness or blameworthiness of actions in virtual environments. This analysis takes not just harm and effects on character into account but the peculiar ways in which speech acts can be morally wrong: e.g. agitatory, deceptive, bullshitting. (shrink)

Providing healthcare services frequently involves cognitively demanding tasks, including diagnoses and analyses as well as complex decisions about treatments and therapy. From a global perspective, ethically significant inequalities exist between regions where the expert knowledge required for these tasks is scarce or abundant. One possible strategy to diminish such inequalities and increase healthcare opportunities in expert-scarce settings is to provide healthcare solutions involving digital technologies that do not necessarily require the presence of a human expert, e.g., in the form of (...) artificial intelligent decision-support systems (AI-DSS). Such algorithmic decision-making, however, is mostly developed in resource- and expert-abundant settings to support healthcare experts in their work. As a practical consequence, the normative standards and requirements for such algorithmic decision-making in healthcare require the technology to be at least as explainable as the decisions made by the experts themselves. The goal of providing healthcare in settings where resources and expertise are scarce might come with a normative pull to lower the normative standards of using digital technologies in order to provide at least some healthcare in the first place. We scrutinize this tendency to lower standards in particular settings from a normative perspective, distinguish between different types of absolute and relative, local and global standards of explainability, and conclude by defending an ambitious and practicable standard of local relative explainability. Linguistic category learning has been shown to be highly sensitive to linear order, and depending on the task, differentially sensitive to the information provided by preceding category markers (premarkers, e.g., gendered articles) or succeeding category markers (postmarkers, e.g., gendered suffixes). Given that numerous systems for marking grammatical categories exist in natural languages, it follows that a better understanding of these findings can shed light on the factors underlying this diversity. In two discriminative learning simulations and an artificial language learning experiment, (...) we identify two factors that modulate linear order effects in linguistic category learning: category structure and the level of abstraction in a category hierarchy. Regarding category structure, we find that postmarking brings an advantage for learning category diagnostic stimulus dimensions, an effect not present when categories are non‐confusable. Regarding levels of abstraction, we find that premarking of super‐ordinate categories (e.g., noun class) facilitates learning of subordinate categories (e.g., nouns). We present detailed simulations using a plausible candidate mechanism for the observed effects, along with a comprehensive analysis of linear order effects within an expectation‐based account of learning. Reduced forms such as the pronoun he provide little information about their intended meaning compared to more elaborate descriptions such as the lead singer of Coldplay. Listeners must therefore use contextual information to recover their meaning. Across languages, there appears to be a trade‐off between the informativity of a form and the prominence of its referent. For example, Italian adults generally interpret informationally empty null pronouns as in the sentence Corre (meaning “He/She/It runs”) as referring to the most prominent referent (...) in the discourse, and more informative overt pronouns (e.g., lui in Lui corre, “He runs”) as referring to less prominent referents. Although children acquiring Italian are known to experience difficulties interpreting pronouns, it is unclear how they acquire this division of pragmatic labor between null and overt subject pronouns, and how this relates to the development of their cognitive capacities. Here we show that cognitive development can account for the general interpretation patterns displayed by Italian‐speaking children and adults. Using experimental studies and computational simulations in a framework modeling bounded‐rational behavior, we argue that null pronoun interpretation is influenced by working memory capacity and thus appears to depend on discourse context, whereas overt pronoun interpretation is influenced by processing speed, suggesting that listeners must reason about the speaker's choices. Our results demonstrate that cognitive capacities may constrain the acquisition of linguistic forms and their meanings in various ways. The novel predictions generated by the computational simulations point out several directions for future research. (shrink)

Its central topic is the question if the object of modern medicine is still the human being or if just organs and tissues are treated by medical doctors? The drawing on the book cover shows a lung instead of a human patient lying in a hospital bed. The approaches to this topic are diverse and surprising. E.g. the surgeon Ankersmit argues that it is impossible for him to see the human (...) being in the body lying on the operation table because then he would be unable to perform his work professionally. The world is brimming with things worth saving, and we have limited time and resources. How do we decide what to save? Why do we make these choices? -/- Philosopher Erich Hatala Matthes explores these questions as they surface (...) in radically diverse contexts--from museums to TikTok, and from National Parks to the corner of your attic. Matthes illustrates the deep relationship between the things we might save and our sense of self. If our cares and concerns are a fundamental part of our identity, then what we care for and preserve will play a significant role in shaping and maintaining our understanding of who we are. In a world in which everything that we care about is subject to powerful forces of change--from climate disturbance and armed conflict, to social transformation and the wear and tear of time--the terms on which we confront change will be key to whether and how we can save the things we care about in the ways that really matter to us. Conflicts in Interpretation applies novel methods of constraint interaction, derived from connectionist theories and implemented in linguistics within the framework of Optimality Theory, to core semantic and pragmatic issues such as polysemy, negation, (in) definiteness, focus, anaphora, and rhetorical structure. It explores the hypothesis that a natural language grammar is a set of potentially conflicting constraints on forms and meanings. Moreover, it hypothesizes that competent language users not only optimize from an input form to the optimal output meaning for this (...) form, or vice versa, but also consider the opposite direction of optimization, thus taking into account the speaker as a hearer and taking into account the hearer as a speaker. The book aims to show that such a bidirectional constraint-based grammar sheds new light on the relation between form and meaning, within a sentence as well as across sentence boundaries, within a single language as well as across languages, and within competent adult language users as well as during language development. An important dimension of the book is the structured investigation of issues at the interface of semantics with syntax and pragmatics, such as the effects of distinguishing between speaker's perspective and hearer's perspective in comprehension and production, stable and instable patterns of form and meaning across languages, and the development of a coherent pattern of form and meaning in children. In this paper, I present an outline of the oppression account of cultural appropriation and argue that it offers the best explanation for the wrongfulness of the varied and complex cases of appropriation to which people often object. I then compare the oppression account with the intimacy account defended by C. Thi Nguyen and Matt Strohl. Though I believe that Nguyen and Strohl’s account offers important insight into an essential dimension of the cultural appropriation debate, I argue that justified objections (...) to cultural appropriation must ultimately be grounded in considerations of oppression as opposed to group intimacy. I present three primary objections to the intimacy account. First, I suggest that in its effort to explain expressive appropriation claims (those that purportedly lack an independent ground), the intimacy account doubles down on the boundary problem. Second, I question whether group intimacy possess the kind of bare normativity that Nguyen and Strohl claim for it. Finally, I argue that these objections give us reason to accept the importance of group intimacy to the cultural appropriation debate, but question the source of its significance as identified by Nguyen and Strohl. The project 'Facing Forward' started with a collaboration between five institutions: the Stedelijk Museum Amsterdam, the Amsterdam School for Cultural Analysis at the University of Amsterdam, De Appel arts centre, W139, the Stedelijk Museum Bureau Amsterdam and the art magazine Metroplis M. Having previously organized the lecture series and publications 'Right About Now: Art & Theory in the 1990s' (2005/2006) and 'Now is the Time: Art & Theory in the 21st Century' (2008/2009), the organizing committee decided to take the final (...) step in this timeline and turn its attention to the far horizon. Informed by a shared interest in the role that history, speculation, and utopianism play in the field of contemporary art and design (as well as the larger context of global, socio-economic and political developments), a selection of seven themes emerged from the conversations of the initial organizers. These would eventually shape the seven lecture and discussions events - collected in this volume of essays - publicized under the banner Art & Theory From a Future Perspective. A great number of internationally renowned speakers were invited to reflect on the proposed themes during often sold-out events, which were presented at the Oude Lutherse Kerk in Amsterdam in 2011/2012. Descartes' works were not allowed to be read at Leiden University, even his name could not be pronounced. Read the compelling story about how his pupil Johannes de Raey has had the opportunity to preach Descartes fully in philosophy, but also in medicine, in a hostile anti-Cartesian climate during 20 years (1647-1668). This book is not only meant for philosophers and medical historians, but for all who want to take a look at the extensive menu of Cartesian cuisine. The 17th-century (...) philosopher René Descartes turned established science upside down by doubting all certainties. His critical mind rejected statements that could not be proven by the Ratio. The Ratio was the metaphor for the roots, the physics for the trunk and the medicine for the branches and leaves of the Cartesian tree. This premise was directly opposed to the established aristotelian theory in which observation formed the basis of knowledge. De Raey, who once called Descartes his best student, synthesized a hybrid model of the old Aristotelian and the new Cartesian concept. From 1658 to 1662 he gave private lessons in medicine at Leiden University and tried to use his model as a basis for explaining human physiology. Until now, nothing was known about the content of these lectures. The author recently found a dispute. It is a new dish on the Cartesian menu. (shrink)

This book offers an introduction to the Sophists of fifth-century Athens and a new overall interpretation of their thought. Since Plato first animadverted on their activities, the Sophists have commonly been presented as little better than intellectual mountebanks - a picture which Professor Kerferd forcefully challenges here. Interpreting the evidence with care, he shows them to have been part of an exciting and historically crucial intellectual movement. At the centre of their teaching was a form of relativism, most famously expressed (...) by Protagoras as 'Man is the measure of all things', and which they developed in a wide range of views - on knowledge and argument, virtue, government, society, and the gods. On all these subjects the Sophists did far more than simply provoke Plato to thought. Their contributions were substantial and serious; they inaugurated the debate on many central philosophical questions and decisively shifted the focus of philosophical attention from the cosmos to man. Is there something morally wrong with cultural appropriation in the arts? I argue that the little philosophical work on this topic has been overly dismissive of moral objections to cultural appropriation. Nevertheless, I argue that philosophers working on epistemic injustice have developed powerful conceptual tools that can aid in our understanding of objections that have been levied by other scholars and artists. I then consider the relationship between these objections and the harms of cultural essentialism. I argue that focusing on (...) the systematic nature of appropriative harms may allow us to sidestep the problem of essentialism, but not without cost. (shrink)

In this paper, we first classify different types of second opinions and evaluate the ethical and epistemological implications of providing those in a clinical context. Second, we discuss the issue of how artificial intelligent could replace the human cognitive labour of providing such second opinion and find that several AI reach the levels of accuracy and efficiency needed to clarify their use an urgent ethical issue. Third, we outline the normative conditions of how AI may be used as second opinion (...) in clinical processes, weighing the benefits of its efficiency against concerns of responsibility attribution. Fourth, we provide a ‘rule of disagreement’ that fulfils these conditions while retaining some of the benefits of expanding the use of AI-based decision support systems in clinical contexts. This is because the rule of disagreement proposes to use AI as much as possible, but retain the ability to use human second opinions to resolve disagreements between AI and physician-in-charge. Some didactical improvements have been made to this edition. An example of a simple model is given and then the general theory (of categorical models) is developed. Indications are given of those parts of the book which can be used to form a coherent course.

This paper wants to shed light on the way the philosophical school of Stoicsm in Greco-Roman antiquity has dealt with the relationship of men and nature by pointing out to some of the key texts in which these issues are mentioned. Although the modern concept of sustainability or environmental protection did not really exist in antiquity, the Stoa was convinced that individual decisions had a direct impact on this world. Following the concept of environmental humanities, the ancient texts and authors (...) are collected as historical ideas of the multifaceted interactions between nature and men that can be fruitfully mirrored with the arguments of the current Anthropocene discourse and its focus on (post)industrialism. By doing so we might come across helpful approaches deeply rooted in our cultural heritage that we could possibly adopt and find practical answers for our age in terms of individual behaviour as well as management decisions to face the ecological and social challenges ahead. Although Darwinian concepts have largely been banned from the social sciences of the last century, they have recently seen a revival in several disciplines such as sociology, anthropology, or economics. Most of the current proponents of evolutionary theorizing in the social sciences avoid references to the older literature on social evolution. On that background, this article presents a contribution to Darwinist thinking in early American sociology that has mainly been overlooked in the literature. As the leading figure of the Human (...) Ecology Approach, which was established during the 1920s and 1930s, Robert Ezra Park drew heavily on evolutionary concepts to explain human evolution. A systematic presentation of these concepts in the light of the modern discussion on sociocultural evolution is given, followed by a conclusion about what can be learned from Park today. (shrink)

Hendrik Lorenz presents a comprehensive study of Plato's and Aristotle's conceptions of non-rational desire. They see this as something that humans share with animals, and which aims primarily at the pleasures of food, drink, and sex. Lorenz explores the cognitive resources that both philosophers make available for the explanation of such desires, and what they take rationality to add to the motivational structure of human beings. It is widely accepted among medical ethicists that competence is a necessary condition for informed consent. In this view, if a patient is incompetent to make a particular treatment decision, the decision must be based on an advance directive or made by a substitute decision-maker on behalf of the patient. We call this the competence model. According to a recent report of the United Nations (UN) High Commissioner for Human Rights, article 12 of the UN Convention on the Rights of (...) Persons with Disabilities (CRPD) presents a wholesale rejection of the competence model. The High Commissioner here adopts the interpretation of article 12 proposed by the Committee on the Rights of Persons with Disabilities. On this interpretation, CRPD article 12 renders it impermissible to deny persons with mental disabilities the right to make treatment decisions on the basis of impaired decision-making capacity and demands the replacement of all regimes of substitute decision-making by supported decision-making. In this paper, we explicate six adverse consequences of CRPD article 12 for persons with mental disabilities and propose an alternative way forward. Recent years have proven rife with revelations about the misdeeds, objectional views, and, in some instances, crimes of popular artists.

According to what we propose to call “the competence model,” competence is a necessary condition for valid informed consent. If a person is not competent to make a treatment decision, the decision must be made by a substitute decision-maker on her behalf. Recent reports of various United Nations human rights bodies claim that article 12 of the Convention on the Rights of Persons with Disabilities involves a wholesale rejection of this model, regardless of whether the model is based on a (...) status, outcome, or functional approach to competence. The alleged rationale of this rejection is that denying persons the right to make their own treatment decisions based on an assessment of competence necessarily discriminates against persons with mental disorders. Based on a philosophical account of the nature of discrimination, we argue that a version of the competence model that combines supported decision-making with a functional approach to competence does not discriminate against persons with mental disorders. Furthermore, we argue that status- and outcome-based versions of the competence model are discriminatory. (shrink)
